- Is defamatory, libellous, harassing, or invasive of privacy.
- Is racially or ethnically objectionable, or promotes enmity, hatred or discrimination against any individual or group on grounds including religion, caste, sex, place of birth, language or sexual orientation.

4.2 Prohibited conduct
- Circumventing, disabling or interfering with the security features of the platform.
- Attempting to extract encryption keys, defeat DRM, or remove or obscure watermarking — whether on your own content or another customer's.
- Reverse-engineering the Service, or using it to build or assist a competing product.
- Reselling, sublicensing or white-labelling the Service without our written permission.
- Sharing account credentials or API keys with unauthorised persons.
- Using the Service for spam, phishing, malware distribution, or fraud.
- Creating multiple accounts to obtain additional free trials or evade a suspension.
- Using the Service as general-purpose file storage or a content delivery network unrelated to video, or in a way that places disproportionate load on shared infrastructure.
4.3 Enforcement
Where we become aware of content or conduct that breaches these Terms, we may remove or disable access to the content, suspend the account, or terminate it — without prior notice where the breach is serious or where continued availability would expose us or third parties to harm or legal liability. For less serious or first-time breaches we will normally notify you and allow a reasonable opportunity to correct the issue.
We do not pre-screen uploads. We act on reports, court orders, and lawful government requests. Where we are required to preserve information or assist a lawful investigation, we will do so.
5. Content Ownership
You retain full ownership of all video content you upload ("Your Content"). By uploading, you grant VideoKavach a limited, non-exclusive licence to store, transcode, encrypt, and serve Your Content solely for the purpose of providing the Service to you.
We do not claim ownership of Your Content and will not use it for any purpose other than operating the Service.
6. Plans, Billing & Payments
- Paid plans are billed monthly or annually in Indian Rupees (INR) via Stripe.
- All prices are exclusive of applicable GST unless stated otherwise.
- Storage and bandwidth limits are enforced as described on the Pricing page.
- Exceeding storage quota will prevent new uploads until you upgrade or delete content.
- Refunds are not provided for partial months. You may cancel at any time and retain access until the end of the current billing period.
7. API Usage
API keys are personal and non-transferable. You are responsible for all activity made with your API keys. Rate limits apply (see documentation). We may revoke API access if misuse is detected.
8. Service Availability
We aim for high availability but do not guarantee uninterrupted service. We will provide reasonable advance notice of planned maintenance. We are not liable for losses arising from temporary downtime.
9. Data Security
We implement industry-standard security measures including AES-128 encryption at rest and in transit. However, no system is completely secure. You are responsible for implementing appropriate access controls on your embed tokens and API keys.
10. Termination
Either party may terminate the agreement at any time. Upon termination, you may request an export of your video metadata within 30 days. After 30 days, we may delete your data permanently. We reserve the right to retain anonymised usage data for analytics.
11. Reporting Content & Takedown
If you believe content hosted on VideoKavach infringes your rights or breaches Section 4, write to [email protected] with:
- The embed URL or video identifier complained of.
- The nature of the complaint, and for copyright claims, evidence of your ownership.
- Your name and contact details, and a statement that the complaint is made in good faith.
We investigate reports promptly. Where content is unlawful or clearly breaches these Terms, we remove or disable access to it and notify the customer who uploaded it. Customers who repeatedly upload infringing content have their accounts terminated.
Where we receive an order from a court of competent jurisdiction or a notification from an appropriate government agency, we act within the timeframe required by law.
12. Grievance Officer
In accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Grievance Officer for VideoKavach is:
- Name: Ms. Shalu Pal
- Email: [email protected]
- Address: 7 Panchvati, Shyam Nagar, Bodla Road, Shahganj, Agra, Uttar Pradesh – 282010, India
We acknowledge complaints within 24 hours and resolve them within 15 days of receipt. Complaints seeking removal of content that is obscene, impersonates another person, or is invasive of bodily privacy are actioned within 72 hours.
13. Lawful Requests & Cooperation
We may disclose account information, access logs or content where required by law, by a court order, or by a lawful request from a government agency acting within its authority. We may also preserve information where we are directed to do so, or where we reasonably believe it is necessary to investigate a serious breach of these Terms.
Because your content is encrypted at rest and in transit, our ability to inspect it is limited. This does not exempt you from responsibility for what you upload, and it does not prevent us from removing content or terminating an account.
14. Limitation of Liability
To the maximum extent permitted by law, VideoKavach's total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, consequential, or punitive damages.
15. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in India. The Information Technology Act, 2000 and applicable Indian law govern the use of this platform.
16. Changes to Terms
We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after changes constitutes acceptance.
